Alimony & Maintenance Lawyer in Punjab
Legal Overview: Types of Maintenance
Financial security is often the biggest concern during a separation. In Indian law, "Maintenance" encompasses the provision for food, clothing, residence, education, and medical attendance. It is not charity but a statutory right designed to prevent destitution.
- Spousal Maintenance: Financial support paid by one spouse to the other during or after divorce.
- Child Support: Mandatory contribution towards the upbringing, education, and welfare of minor children, separate from spousal maintenance.
- Parental Maintenance: Under Section 125 CrPC, senior citizens/parents unable to maintain themselves can also claim maintenance from their adult children.
Applicable Laws
- Section 125 CrPC: A secular, speedy remedy available to wives, children, and parents to claim maintenance from a person having sufficient means who refuses to maintain them.
- Hindu Marriage Act, 1955 (Section 24 & 25): Provisions for pendente lite (interim) maintenance during the trial and permanent alimony upon divorce.
- Protection of Women from Domestic Violence Act, 2005: Empowers magistrates to grant "monetary relief" to meet expenses incurred as a result of domestic violence.
- Muslim Women (Protection of Rights on Divorce) Act, 1986: Governs maintenance rights for Muslim women after the iddat period.
Step-by-Step Procedure
1. Filing the Application
A detailed petition is filed under the relevant act (usually Sec 125 CrPC or Sec 24 HMA) in the Family Court, accompanied by an affidavit of assets and liabilities (as mandated by the Supreme Court in Rajnesh v. Neha).
2. Income Assessment
Both parties must disclose their true income. If the respondent hides income, we use bank statements, lifestyle evidence, and credit card bills to prove their actual financial capacity.
3. Interim Order
Recognizing that trials take time, the court passes an interim order for monthly maintenance to ensure the petitioner is not left destitute during the proceedings.
4. Final Argument & Order
After evaluating evidence and cross-examination regarding financial status, the court passes a final maintenance order, which can be retrospective from the date of application.
Documents Required
To secure a favorable maintenance order, strict documentary proof of the spouse's income is vital:
- Income Tax Returns (last 3 years).
- Salary Slips or Employment Contracts.
- Bank Account Statements (last 6-12 months).
- Proof of business ownership/shareholding.
- Credit Card Statements showing spending habits.
- Property Deeds or Vehicle Registrations.
- Receipts of children's school fees and expenses.
- Medical expenditure records.
Jurisdiction & Courts
Maintenance petitions can be filed in the Family Court or District Court within whose jurisdiction the wife resides, the husband resides, or where they last resided together. Section 125 CrPC petitions can be filed anywhere the wife is currently staying. In Punjab, these cases are heard in district courts across Amritsar, Ludhiana, Jalandhar, Patiala, and Bathinda, as well as the Mohali District Courts.
